Wills and Estate Planning

In Texas, a will allows for any children, spouses, other family members, and even pets to be provided for upon death. The creation of a will is an integral step in planning the distribution of a person's estate, real and personal property, after death.

An attorney creating the will works with the testator (person making the will) to assign a person (executor) to administer a will and testament after the death of the testator.

Probate Law

In Texas, the Probate process entails a review of the validity of the decedent's will and gives the executor the authority to settle the estate. At the hearing, the attorney and executor must also prove that he or she is not disqualified from serving.

If the court is satisfied that all the requirements have been met according to Texas law, an order is signed admitting the will to probate, and thus granting the executor the authority to settle the estate.
